Please read these Terms before you place an order. They form a binding agreement between you and HUY LANH LLC.
cheerlygifts.com is operated by HUY LANH LLC. By accessing or purchasing from cheerlygifts.com, a website operated by HUY LANH LLC, you agree to these Terms of Service and to the policies they refer to, including our Shipping Policy, Return & Refund Policy, Payment Policy and Privacy Policy.
In these Terms, "Cheerlygifts", "we" and "us" mean HUY LANH LLC as the operator of cheerlygifts.com. If you do not agree to these Terms, please do not use the website.
You must be at least 18 years old, or the age of majority in your state, to place an order. You must have a valid shipping address in one of the 50 United States.
You agree to give accurate and complete information when you place an order. Your order is an offer to buy. We accept it when we send an order confirmation email.
We may refuse or cancel an order for suspected fraud, a pricing error or an excluded shipping address. If we cancel, we refund your full payment.
All prices are in US dollars. We accept PayPal as our payment method, including card payments through PayPal Guest Checkout. The price displayed is the final product price. Any applicable sales tax, if required by your state, will be calculated at checkout.
If a price on the website is wrong because of a clear error, we will contact you before production and let you confirm or cancel the order.
Every product is made to order. Production takes 2–5 business days and delivery takes 3–5 business days, for a total of 5–10 business days. Business days are Monday - Friday, excluding public holidays (Mon–Fri, 9:00 AM – 5:00 PM MT).
Shipping costs a $4.95 flat rate per order. We ship to all 50 United States, including Alaska & Hawaii, and not to P.O. Boxes, APO/FPO/DPO addresses, US territories or international addresses. Risk of loss passes to you when the package is delivered to your address.
You may return or exchange items in 30 days from the delivery date, for both defective and non-defective items. We do not charge a return shipping fee and we do not charge a restocking fee. Orders can be canceled during the first 12 hours after you place them. Full details are on our Return & Refund Policy page.
Product photos are mockups of printed items. Printed colors can look slightly different from your screen, and print placement can vary slightly from item to item. All products are sold in adult sizes.
We may change or stop offering any design or product at any time. If an item you ordered can no longer be produced, we will notify you and refund it in full.
All content on cheerlygifts.com, including designs, text, graphics, logos and images, belongs to HUY LANH LLC or its licensors. You may not copy, reproduce, sell or distribute it without our written permission.
You agree not to use the website for any unlawful purpose, to place fraudulent orders, to give false information, to copy content with automated tools, or to interfere with the security or operation of the website.
The website and its content are provided "as is" and "as available" to the extent permitted by law. We do not promise that the website will always be available or free of errors.
Nothing in these Terms limits your rights under our Return & Refund Policy or any consumer rights that cannot be waived under law.
To the extent permitted by law, HUY LANH LLC is not liable for indirect, incidental or consequential damages arising from your use of the website or products. Our total liability for any claim is limited to the amount you paid for the order involved.
You agree to defend and hold harmless HUY LANH LLC and its members and partners from claims arising from your breach of these Terms or your misuse of the website.
Services such as PayPal and USPS, UPS and FedEx are run by third parties under their own terms. We are not responsible for their content, policies or actions.
Our Privacy Policy page explains how we collect, use and protect your personal information. By using the website, you agree to that policy.
We may suspend or end your access to the website if you break these Terms. Sections that by their nature should survive, such as Intellectual Property, Limitation of Liability and Governing Law, remain in effect.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. Any legal action must be brought in the state or federal courts located in Natrona County, Wyoming.
If you have a problem with an order, please email [email protected] first. We will work with you in good faith for 30 days to solve it before either side takes formal action. You may also bring an eligible claim in small claims court.
We may update these Terms from time to time. Changes take effect when posted, and we update the Last updated date at the top of this page. Orders placed before a change are governed by the Terms in effect when the order was placed.
